- This is a limited period promotional Offer ("Offer") being run by Zepto and sponsored by Mondelez India Foods Private Limited (“MDLZ”) and made available on the mobile application/ website of Zepto Private Limited (hereinafter referred to as "Offer Partner").
- These offer terms and conditions ("Offer Terms") are in addition to the https://www.zeptonow.com/terms-of-service, Terms of Use and https://www.zeptonow.com/privacy-policy, Privacy Policy to which you agree by using the Platform. To the extent the Terms of Use and Privacy Policy are inconsistent with these Offer Terms, these Offer Terms will prevail with respect to the Offer only.
- By participating in this Offer (defined below), the user (“Customer” or “You” or “Your”) agrees to be bound by these terms and conditions (“T&C”); the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform.
- This Offer shall run from 9th Feb 2025 to 14th Feb 2025 (both days inclusive) ("Offer Period") unless prematurely revoked by Zepto (“Offer Partner”) or MDLZ at their sole discretion, without prior notice.
- Customers are not bound in any way to participate in this Offer. Any participation is voluntary, and the Offer is being made purely on a best effort basis.
- Eligibility Conditions:
The Eligibility criteria for participation in this offer is:
a. Customer needs to be a natural person;
b. Customer should be an individual legal resident and citizen of the Republic of India;
c. Customer should be of an age 18 years or above at the time of entry into the offer/campaign;
d. Customer shall be legally competent to enter into binding contract under the applicable laws of India.
e. Customer must hold a valid PAN card issued under the provisions of the Income-Tax Act, 1961.
f. As this Offer is valid only on the purchase of minimum Rs 250 worth of stocks of MDLZ (“Cadbury Silk”) branded product (“Product(s)”) in a single bill within the period from the Offer Partner and is valid only on Cadbury Silk SKUs (mentioned in Annexure I), Customer is required to make the aforesaid purchase from the Offer Partner online platform.
g. This Offer is not valid in the state of Tamil Nadu - Prizes:
During the Offer Period, any Customer who fulfils the eligibility criteria of purchasing minimum Rs. 250 worth of Product(s) in a single bill from the Platform (“Eligible Customers”) shall stand a chance to win the Prizes as detailed in Point 9.
- Notwithstanding anything contained herein, this Offer will not be available on any Products which are returned or refunded by the Eligible Customer or if the order for such Products are cancelled by the Eligible customer.
- Winning criteria:
During the Offer Period, to be eligible to win merchandise a customer must:
a. Purchase a Mondelez India Foods Pvt Ltd (“Cadbury Silk”) branded product (“Product(s)”) worth Rs. 250 or more from Offer Partner platform (“Eligible Customers”).
b. 1 Lucky Winner/ Participant who will win a Make my Trip voucher worth Rs 1,50,000.
c. Winner Selection, Winner Announcement and Contacting Winners:
1. Offer Partner will select the list of winners using the randomizer from the list of shoppers fulfilling the above criteria. If you are selected as the winner, you will receive a notification via WhatsApp or email from Offer Partner. This message will include all the necessary details for redeeming your prize. Offer Partner’s decision regarding the selection of winners and all matters related to the offer shall be final and binding.
2. The Winner details will be shared by the Offer Partner to Mondelez India Foods Private Limited Appointed Winner Management Partner (“Big City Promotions”) within 30 days from the end of the Contest Period.
3. You hereby provide your consent to the Offer Partner to share your contact details and PAN details (“Information”) with MDLZ’s Winner Management Partner (“Big City Promotions”) and also with MDLZ on being declared as a winner. - The final winner details will be shared by the campaign partner with email id- gv-orders@bigcity.in
- You may only avail this Offer if you (a) have set India as your current country in your account settings on the Platform; and (b) have a billing address in India, except in the state of Tamil Nadu as per the Tamil Nadu Prize Schemes Prohibition Act, 1979.
- The Offer Partner and MDLZ reserve the absolute right to withdraw and/or alter any of these Offer Terms at any time without prior notice.
- The Offer shall be subject to force majeure events and on the occurrence of such an event, the Offer may be withdrawn at the discretion of Offer Partner or MDLZ.
- The merchandise/prizes can neither be sold nor encashed or exchanged for any other Products.
- The Customer agrees that this Offer is provided by Offer Partner on MDLZ Products. The Customer agrees that MDLZ shall not be responsible if this Offer is in violation with any applicable law. The customer also agrees that MDLZ shall not be responsible for any breach of any agreement pertaining to the offer between the Customers and Offer Partner (whether during or after the Offer and whether) and Customer shall not raise any claim of any nature whatsoever against MDLZ and/or their directors, employees, officers, affiliates, sponsor and/or subsidiaries related to this offer.
- This T&C shall be governed in accordance with the applicable laws in India. Courts at Mumbai shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
- For any query regarding this offer, consumer may raise a query through the “Help Center” section on Offer Partner app. Offer Partner will not entertain any correspondence or communication regarding the products associated with this offer from any customer/persons.
- The Offer shall be subject to the Income-Tax Act, 1961 and all disbursements shall be subject to TDS, as applicable.
- This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
- By participating in this Offer, you will be deemed to have accepted these terms and conditions and expressly agree that: (a) Offer Partner and its directors will not be liable or responsible for any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer; (b) Offer Partner and its directors will not be liable for theft, loss or misuse of the Tickets or the Information.
- You may only avail this Offer if you are: (a) located in India, except Tamil Nadu; (b) have set India as your current country in your account settings on the Platform except Tamil Nadu; and (c) have a billing address in India except Tamil Nadu.
- Merchandise/prizes are sponsored by Mondelez India Foods Private Limited but the winners will be selected basis a lucky draw at the sole discretion of the Offer Partner. Offer Partner’s decision regarding the selection of winners and all matters related to the Offer shall be final and binding. The Offer partner is not responsible for distributing the merchandise. Customer also agrees that Offer Partner shall not be responsible for any claim of any nature whatsoever against Offer Partner and/or their directors, employees, officers, affiliates, sponsor and/or subsidiaries related to the delivery, receipt, non receipt or usage of merchandise.
General Terms & Condition
- By taking part and/or entering into the Contest the participant warrants that all information provided by participant regarding participant's name, phone number, etc., is true, correct, accurate and complete
- The Campaign shall remain valid till the stock/Reward lasts.
- The decision of Mondelez India Foods Private Limited (“MDLZ”) as regards the Prize and Mega Prize shall be final and binding. No correspondence or any other claims whatsoever, in this regard will be entertained.
- The Prize and Mega Prize is non-transferable and can only be claimed by the winner and cannot be exchanged or redeemed for cash.
- No cash alternative to the Reward will be offered. The Reward is not transferable and/or exchangeable.
- No queries, claims, dispute, complaints or grievances shall be entertained by MDLZ and/or Zepto after the Contest Period.
- MDLZ reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of MDLZ in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and conclusive.
- MDLZ shall provide the Prize and the Mega Prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or merchantability and MDLZ and the Agency shall not be responsible for or liable for deficiency or defect in the Prize or the Mega Prize or for any kind of consequential damages/ loss in any manner whatsoever. If you have any grievance with respect to the Prize or the Mega Prize, you may directly contact its maker/marketer.
- These offers shall not be applicable within the territorial boundaries of the state of Tamil Nadu.
- Nothing contained herein amounts to a commitment or representation by MDLZ to conduct further contests.
- The decision of MDLZ shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any participant and MDLZ and the participant shall not have the authority to bind MDLZ in any manner whatsoever.
- MDLZ or Zepto shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the Prize and Mega Prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, internet failure or any other force majeure conditions, etc., and shall not be liable to compensate the participant in these circumstances.
- MDLZ or Zepto shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.
- Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of MDLZ.
- MDLZ or Zepto accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of internet connectivity, unique codes, documents or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. MDLZ or the Zepto shall not be liable for any consequences of user error including (without limitation) costs incurred.
- MDLZ in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, to add, alter, modify, change or vary all or any of these terms & conditions, wholly or in part, prospectively or retrospectively, or to withdraw the Contest. Participants undertake the responsibility to update themselves of the changed terms & conditions available here.
- The gratification in this Contest cannot be used in conjunction with any alternative offer or promotion.
- Any attempt by a participant to deliberately damage or undermine the legitimate operation of the Contest and/or website is a violation of the laws and should such an attempt be made, MDLZ reserves the right to seek damages from any such participant to the fullest extent as permitted by law.
- Neither MDLZ nor Zepto and/or its subsidiaries shall not be liable to any person or entity for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the winner or any third party, whether in connection with this Contest, or for breach of any warranty or in tort.
- If a participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.
- If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
- MDLZ or Zepto will not be responsible for non-receipt or delayed receipt of any information submitted by the participant.
- By taking part in this Contest, you agree to provide this information and personal information to MDLZ and Zepto that conducts this Contest. The data and information we collect shall be used for (a) considering your participation in the Contest, (b) providing the Prize to the winners and (c) for any subsequent direct marketing by MDLZ, its associate / subsidiary Companies, either directly or through any designated Agency. MDLZ will not sell or transfer such information to any third party for purposes other than those mentioned above. You may opt out of such emailers/communication at any time if you may desire so.
- MDLZ, Zepto and the participant shall be independent contractors. None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between the participant and MDLZ and the Zepto. The participant shall have no authority to bind MDLZ and the Zepto in any manner whatsoever.
- The participants, winner(s) of the Contest hereby indemnifies and agrees that he/she/they shall hold harmless MDLZ and Zepto, its employees, officers or any other person in relation to the same with regard to any injury/damage/harm/loss suffered by him/her/them in any manner, whatsoever, arising from any of their acts/omission /inactions/statements etc. in connection with the Contest including the Prize.
- All disputes arising out of or in connection to this Contest shall be governed under the laws of India and shall be subject to exclusive jurisdiction of the courts in Mumbai only.
- All queries with respect to the Offer shall be sent to support@zeptonow.com. All endeavours shall be made to address your queries. However, it is clarified that no response shall not be construed as a deficiency or an act of omission on the part of Zepto (Campaign Partner).
- Participation in the Contest is voluntary.
- No cash alternative to the reward will be offered. The rewards are not transferable and/or exchangeable.
- Where the value of the reward exceeds the exemption limit under Income Tax Act, 19 winner shall bear all applicable taxes including but not limited to income (withholding) tax and any other statutory levy as may be applicable from time to time in relation to the Campaign.
- The merchandise/prizes can neither be sold nor encashed or exchanged for any other Products.
